Principles of Building Science Training Event Scheduled for Nov.

The Environments For Living® green building rating program is offering a two-day training event in Phoenix on Nov. 9 and 10, featuring national building technology leader John Tooley. Participants in the class will learn key principles of building science focused on developing environmentally responsible homes that are energy efficient, durable and comfortable.

The course is designed to help building professionals compete more effectively in today's housing market by understanding green building issues of importance to home buyers. Participants will learn techniques for green home construction, including improved energy performance, indoor air quality and moisture management. The training will cover the following topics:

•Improving the thermal boundary
•Developing a conditioning strategy that works in your climate
•Understanding and implementing moisture management
•Offering indoor environmental quality in your homes

July Heating and Cooling Equipment Shipment Data Released

Warm Air Furnaces
U.S. factory shipments of gas-fired, warm-air furnaces in July totaled 161,301 a 13.8 percent drop compared with the same month a year ago. For the year-to-date, gas furnace shipments totaled 1,056,915, a 14.8 percent drop compared with the same period last year.

Oil-fired, warm-air furnaces for the same month totaled 3,057, a 11.2 percent increase compared with July 2008 totals. Oil furnace shipments for the year-to-date totaled 21,526 a 18.1 percent drop compared with the same period last year.

Storage Water Heaters
Residential electric water heater shipments for July totaled 283,854, an 18.5 percent drop from the same month a year ago. Residential gas water heater shipments totaled 269,335, a 10.6 percent decrease compared with shipments for the same month last year. For the year-to-date, about 2,183,800 residential gas water heaters have been shipped, about 11.3 percent drop compared with the same period a year ago. For the year-to-date, about 2,209,732 residential electric storage water heaters have been shipped, a 13.9 percent drop compared to the same period last year.

Commercial gas water heater shipments for July totaled 5,523, dropping 13.5 drop percent compared with the same month last year, while commercial electric water heater shipments totaled 4,555 a 17.1 percent drop compared with the same month a year ago. For the year-to-date, commercial electric water heater shipments totaled, 33,870, 18.4 percent behind total shipments of this product during the same period last year (41,523). Commercial gas water heater shipments (45,854) for the year-to-date are down 16.7 percent, compared with the same period a year ago (55,055).

Central Air Conditioners and Air-Source Heat Pumps
Combined U.S. factory shipments of central air conditioners and air-source heat pumps for July totaled 568,197, down 16.1 percent compared with the same month a year ago. For the year-to-date, combined shipments totaled 3,353,331, down 17.7 percent compared with the same period last year.

Heat pump shipments for July totaled 1,073,924, up 14.6 percent from the same month a year ago. For the year-to-date, heat pump shipments totaled 687,744, a 12.6 percent drop compared with the same period last year.

Baby Boomers will reminisce 1969s three days of peace and music at a variety of Webbstock celebrations at Del Webb communities across Northern California.

Woodstock, the largest rock concert ever conceived and widely regarded as one of the greatest moments in popular music history, celebrated its 40th Anniversary last month.

"Woodstock has become a historic symbol with different meanings to thousands of people. To me, it sparks memories of good feelings from years ago," said Lou Reinitz, a Del Webb resident who was 32 years old at the time. "The 40th Anniversary of Woodstock makes me think back to that care-free time in my life and to all the wonderful music."

The public is invited to join Del Webb's "Webbstock Festival" celebration at the three Northern California Del Webb communities. The Club in Roseville, Glenbrooke in Elk Grove and Woodbridge in Manteca are all hosting simultaneous Webbstock events on Sat., Sept. 12th from 11 a.m. to 5 p.m. All are free and open to the public.

Thirty-two of the best-known musicians of the day appeared during the sometimes rainy weekend in front of nearly half a million concertgoers at Woodstock in 1969.

"Many Del Webb residents lived through--and some even attended--the great festival," said Patrick Higgins, California Area Vice President of Sales. "For the 40th Anniversary, what better way to bring the fun of the 60s and the Woodstock festival back to life than a groovy celebration at Del Webb communities," Higgins said.

FMI releases Nonresidential Construction Index for Q3 2009

The NRCI index for the third quarter is 44.8 and essentially unchanged from the second quarter reading of 45.0. This result leads us to think we are seeing the bottom of this long recession for nonresidential contractors. However, there isn’t much this quarter indicating recessionary conditions, for nonresidential contractors at least, are going to end soon.

Most panelists see the short-term outlook as slightly less bad than last quarter, and we will take that as a good sign, even if a small one. A more important and telling sign is seen in this quarter’s results for the one to three year outlooks for major construction markets. Panelists have reigned in their longer-term optimism, which seems to signal they are expecting a protracted recovery.

The American Recovery and Reinvestment Act (ARRA) hasn’t yet been that stimulating for nonresidential construction and has led to a certain amount of frustration in the responses this quarter. The hope for a quick recovery has faded, and contractors are now slugging it out in the trenches trying to keep their backlogs full and facing increasing competition.

Nonetheless, this recession will end, and when it does, there is a growing sense that there will be a lot of changes in the industry. For instance, panelists expect much more work will come from the public sector than from private owners as the recession recedes, and the move to green construction continues to represent a growing trend.

NRCI Third Quarter 2009 Highlights:

* Overall Economy: Panelists sense the overall economy is improving significantly from last quarter with this NRCI component moving from 34.9 to 43.5. Note, this is still in recession territory, but moving in the right direction.

* Overall Economy Where Panelists Do Business: Looking closer at home markets, panelists are slightly less glum about the outlook than last quarter with a component index score of 37.1 compared with 34.5.

* Panelists’ Construction Business: In the early stages of the recession, when panelists were still working on long backlogs, their markets and businesses were markedly better than the overall economy. That has now changed as panelists’ backlogs have slowly declined from a median of nine months last quarter to eight months this quarter. Even though they expect those backlogs to continue to decline next quarter, they see their business as slightly improving to 35.7 compared with 32.2 last quarter.

* Cost of Materials: Although panelists still see material prices going lower, there are signs that, in general, material prices are beginning to stabilize with 60% of panelists reporting no change from last quarter, giving us a component index of 63.8 compared with 77.1 last quarter.

* Cost of Labor: Like materials costs, labor costs appear to be stabilizing and may even show some signs of rising as the index changed slightly from 54.7 last quarter to 52.2 this quarter.

* Productivity: Productivity increases remain in the positive range as contractors struggle to be more efficient in the face of greater competition and lower profit margins. The component index for productivity is down slightly to 62.4 compared with 63.3 last quarter.

* Delays and Cancellations: Delays and cancellations continue to plague nonresidential construction, and are currently unchanged from last quarter with delays running at 20% or four times a normal rate, and cancellations occurring at five times normal. As reported by one panelist, one reason this figure isn’t worse is due to projects being cancelled or delayed while still on the drawing board.

* Effects of the American Recovery and Reinvestment Act (ARRA): Only 21.9% of panelists are seeing some work trickle into their backlogs from the ARRA funds. Few panelists in the nonresidential construction markets expect the ARRA to stimulate their business. At best, it is helping to replace some work that would have been lost due to the recession. At worst, it may be causing delays in some publicly funded projects, creating a bureaucratic morass and leading to fierce competition in already tight markets.

Economy brings end to SAHBA-SACA affiliation

Due to ongoing economic stress in the home building and development industry, the 4 1/2-year business affiliation between the Southern Arizona Home Builders Association (SAHBA) in Tucson and the Southeastern Arizona Contractors Association (SACA) in Sierra Vista has ended by mutual agreement.

SAHBA and SACA affiliated on Jan. 1, 2005, to strengthen the political and economic impact of the region's building industry. SACA’s approximate 90 members in Cochise County were rolled into SAHBA's significant organizational, political, community service and educational structure.

SAHBA Interim President Art Flagg said the decision to end the alliance "was extremely difficult and done with deep regret. In just a short period of time, together we had raised the profile and credibility of the construction industry with State and local legislators, and the general public."

In addition to working on regulatory and legislative issues, the two associations had worked together on member education and events, community service and the SACA Home Show.

SAHBA represents 675 member businesses and 30,000 jobs serving the residential construction industry in Pima and Cochise counties.

Albiasa Corporation, a subsidiary of Spanish based Albiasa Solar, will hold an open house Thursday, July 9, from 5-7 p.m. at the Wigwam Resort, Arizona Room, to discuss its planned 200 megawatt (MW) concentrating solar power (CSP) plant in Mohave County near Kingman.

Assisted by the Arizona Department of Commerce, Albiasa's project will create up to 2,000 construction jobs and more than 100 permanent jobs for Arizonans.

The Albiasa Kingman project involves over $1 billion capital investment and, with molten salt thermal storage, will generate more than 665,000 MWh of renewable solar energy annually. It should be completed in 2013.

U.S. EPA orders City of Holbrook to comply with Clean Water Act to protect Arizona water

The U.S. Environmental Protection Agency has ordered the City of Holbrook to comply with its wastewater permit after the city failed to respond to a State-issued Notice of Violation.

The order follows nearly two years of attempts by State and federal regulators to bring the city into compliance. Holbrook failed to submit monthly discharge reports for 23 consecutive months and failed to submit monitoring reports characterizing the quality of its treated wastewater, both violations of mandatory terms in the city’s permit.

“Holbrook must comply with all conditions of its wastewater permit, including the required monitoring and reporting,” said Alexis Strauss, the EPA’s Water Division Director for the Pacific Southwest region. “Dischargers are responsible for water quality monitoring to show us, and the public, they’re complying with their permit and protecting Arizona’s waters.”

The order requires the city to submit all missing records and reports within 30 days and come into compliance with their wastewater permit. In addition, within 60 days, the city of Holbrook must submit a report detailing all costs associated with complying with the order.

The City of Holbrook holds a permit for the Painted Mesa Water Reclamation Facility which covers discharge of treated wastewater to the Leroux Wash, a tributary to the Little Colorado River. The Little Colorado River is used for swimming, boating and is a drinking water source for some communities.

Water pollution degrades surface waters making them unsafe for drinking, fishing, swimming, and other activities. As authorized by the Clean Water Act, the National Pollutant Discharge Elimination System permits are used to regulate the discharge of pollutants into waters of the United States.

Az Contractors Association seeking contractors interested in large-scale solar project presentation

David Jones, president and CEO of the Arizona Contractors Association, put out a call for contractors interested in working on a large solar facility near Phoenix.

“I recently spoke with a representative of an owner engineering firm who is performing a labor and contractor study of the greater Phoenix, Arizona area to determine the availability of labor and contractors to construct a 290 MW Solar facility approximately 65 miles west of Phoenix,” Jones said in a press release. “This project consists of erection of approximately three (3) square miles of solar assemblies, a 290 MW power plant, a thermal storage facility, and all the necessary balance of plant (BOP) systems.”

Jones said it is the intent of the Arizona Contractors Association to assure that all of this work is performed by Arizona contractors.

“In order to do this I have invited representatives of the owner engineering firm to present the requirements and qualifications necessary to perform work at this facility,” Jones said. “I have been assured that the majority of the construction and erection efforts are no different than the typical work performed by the Arizona Contractors on a daily basis.”

Jones said a date has not yet been set for the presentation, however, he is asking for feedback to determine the level of interest in attending such a presentation.

AHRI Opposes House Energy Bill in Current Form

The Air-Conditioning, Heating, and Refrigeration Institute announced its opposition to H.R. 2454, the American Clean Energy and Security Act of 2009 (ACES Act) in its current form. If the bill is passed into law, it would, among many other onerous provisions, eviscerate the federal preemption provisions of the National Appliance Energy Conservation Act (NAECA) and the Energy Policy act of 1992 (EPACT).

"In its current form, the ACES Act would effectively allow any jurisdiction in the nation to enact its own energy policy through the use of prescriptive building codes, severely impacting the ability of heating, air conditioning, and commercial refrigeration manufacturers to provide products to residential and commercial customers in the most timely, efficient, and economical way," said AHRI President Stephen Yurek.

"Allowing any building code, anywhere in the country, to specify an efficiency level for residential and commercial heating, cooling, and commercial refrigeration equipment would quite simply create marketing and distribution chaos for our member companies, distributors, and contractors, in addition to threatening thousands of American jobs at a time of economic turmoil and high unemployment," Yurek said.

Yurek stated that AHRI much prefers the Senate's approach to decreasing energy intensity.

"We, as an industry, negotiated the federal preemption provisions of NAECA and EPACT in good faith, obtaining those provisions in exchange for being regulated for the first time with regard to energy efficiency," Yurek said, adding that, "We have unequivocally kept our end of the bargain, and our products are more efficient than they have ever been. Up until now, Congress and regulatory agencies have kept their end of the bargain, as well. The result has been a very productive arrangement that has -- and will -- save the nation enormous amounts of energy - 54 quadrillion BTUs through 2030. We will vigorously oppose any attempt to change the rules that have worked so well to preserve American jobs, and protect American consumers and the environment."

Studies show that more than 60 percent of the homes in America have outdated, less-efficient HVAC systems. Rather than allow states and localities to set their own energy conservation standards through building codes, AHRI believes that Congress should revise and expand the tax credits contained in the stimulus bill to allow more Americans to at least bring their heating and cooling systems to the federal minimum efficiency level.

"We strongly believe that if a reduction in energy intensity is the goal - as Congress has said many times it is - the focus has to be on upgrading the nation's installed base of heating and cooling equipment. It is of little use for Congress to try and micromanage our industry while average homeowners struggle to afford replacement of their old heating and cooling systems," Yurek said. "As an industry that has a proud record of producing highly energy efficient products, we are eager to work with Congress to accomplish the nation's energy reduction goals. But Congress needs to leave manufacturing, distribution, installation, and maintenance to the experts, and concentrate on providing incentives that allow average Americans to save energy and money," he said.

First time home buyers should buy now to qualify for federal tax credit

Time is running out for home buyers looking to purchase their first home and qualify for the $8,000 Federal tax credit. According to the National Association of Home Builders (NAHB) first time home buyers looking to purchase a new home in 2009 and take advantage of the $8,000 first time home buyer tax credit, should do so immediately in order to qualify. 2009 International Greenbuild Conference selects Optima Camelview for project tour

Optima Camelview has been selected as one of the 18 Arizona tours during the 2009 International Greenbuild Expo and Conference, occurring Nov. 11th through Nov. 13th and expecting to draw some 25,000 to 30,000 attendees.

The tours committee deliberated over 92 proposals before assembling 18 tours for recommendation to the national US Green Building Council for approval. The proposals included a variety of green building projects in residential and commercial architecture and some Arizona landmarks that were important to the history of sustainable development. The final selection was bound by a limited number of available tours and the need to consider each tour site in conjunction with other tour offerings.

Barry Rutenberg, a Gainesville, Fla.-based home builder with more than 30 years of experience in the building industry, was elected as the 2009 Third Vice Chairman of the Board of the National Association of Home Builders (NAHB) during the association's International Builders' Show in Las Vegas.

Rutenberg is president of Barry Rutenberg and Associates, Inc. in Gainesville. His firm has developed more than a dozen communities and 1,000 homes in the Gainesville area.

"NAHB is looking forward to working with the Obama Administration and the nation's lawmakers to address the foreclosure crisis that is hurting so many families," Rutenberg said. "We need to stabilize housing prices, revitalize the home building industry and restore confidence in the American economy."

Rutenberg has been active in the NAHB leadership structure at the local, state and national levels throughout his career. He has served on NAHB's Board of Directors since 1980 and served on more than 20 NAHB committees and councils. He has served as an NAHB national vice president representing Florida and Puerto Rico three different times - 1994-1995, 2001-2002 and 2007-2008.

Rutenberg has also served as chairman of NAHB's Building Materials Task Force, and in that role he has testified before the International Trade Commission and committees of the U.S. Senate and the Canadian House of Commons.

A third-generation home builder, Rutenberg served as the 2000 president of the Florida Home Builders Association. He also served as the 1978 president of the Builders Association of North Central Florida, the local association representing home builders in the Gainesville area.

He was selected by his peers as Florida Builder of the Year in 1994, and as the Gainesville Builder of the Year in 1982, 1993 and 1998. In 2007 Rutenberg joined his father, Arthur Rutenberg, as an inductee in the Florida Housing Hall of Fame. Arthur Rutenberg was inducted in 1996, and when Barry joined him in 2007 they became the first father-son team in the Florida Housing Hall of Fame.

Rutenberg said he believes NAHB must be receptive to new ideas during this challenging time.

"Just as there is change in Washington in 2009, there will be change at NAHB in the years ahead," he said. "We have to work harder and smarter to meet our members' needs. We must be there for them in Washington, and we must support our members' efforts at the state and local levels."

Rutenberg is involved in a wide range of philanthropic and civic organizations in Florida. He serves on the Board of the Gainesville Area Chamber of Commerce. He also serves on the Board of Directors of the Conservation Trust for Florida and on the Issues Advisory Board of Florida Defenders of the Environment.

Rutenberg graduated from Northwestern University with a Bachelor of Science degree in 1970 and earned a Master of Business Administration (MBA) Degree from Harvard in 1972.

KB HOME AMENDS RIGHTS PLAN AND ADOPTS SUCCESSOR RIGHTS PLAN TO PRESERVE THE LONG-TERM VALUE OF ITS NET DEFERRED TAX ASSETS

KB Home (NYSE:KBH) announced today that its board of directors adopted an amendment to its stockholder rights plan and a successor rights plan that are intended to preserve the long-term value of the Company’s net deferred tax assets. KB Home has net deferred tax assets of approximately $880 million that it believes could be used to potentially offset the income tax expense on approximately $2.2 billion of future taxable income for a 20-year period.

KB Home’s ability to use its net deferred tax assets could be substantially reduced in the event of an “ownership change” under Section 382 of the Internal Revenue Code. An “ownership change” would occur if stockholders that own (or are deemed to own) at least 5% or more of KB Home’s outstanding stock increase their cumulative ownership by more than 50 percentage points over their lowest ownership percentage within a rolling three-year period.

The amendment is intended to reduce the likelihood of an “ownership change” by reducing the ownership threshold for exercising the rights issued under the stockholder rights plan from 15% to 4.9% of the outstanding common stock. The successor rights plan has substantially similar terms and will take effect when the rights under the existing plan expire on March 5, 2009. The Company intends to seek stockholder approval of the successor rights plan, which will expire on March 5, 2010 if not approved by stockholders before that date.

“After careful consideration, our board of directors has determined that it is in the best interests of the Company and our stockholders to modify our stockholder rights plan at this time, and to extend its protection of our net deferred tax assets by adopting a successor rights plan,” said Jeffrey Mezger, president and chief executive officer.

“Our net deferred tax assets represent a substantial potential benefit that can be realized as future income is generated. We are taking this step to preserve the long-term value of our net deferred tax assets.”

ABC Supports Legislation to Protect Majority of Construction Workforce

Associated Builders and Contractors (ABC) today came out in strong support of the Government Neutrality in Contracting Act (S. 90), a measure to codify into law Executive Order 13202 barring federal agencies from requiring union-only project labor agreements on federal construction projects. Sen. David Vitter (R-La.) introduced the bill.

“ABC urges quick congressional passage of this important legislation,” said Jerry Gorski, 2009 ABC national chairman and president of Gorski Engineering, Inc., Collegeville, Pa. “The Government Neutrality in Contracting Act ensures that all contractors and all workers – both union and merit shop – have a fair and equal opportunity to participate on federally funded and federally assisted construction projects.”

A union-only project labor agreement (PLA) is a contract that requires a federal project to be awarded only to contractors and subcontractors that agree to recognize unions as the representatives of their employees on that job; use the union hiring hall to obtain workers; pay union wages and benefits; and obey the union’s restrictive work rules, job classifications and arbitration procedures.

“According to the Bureau of Labor Statistics, union membership in the U.S. construction industry stood at 13.9 percent in 2007,” said Gorski. “Union-only PLAs drive up costs for American taxpayers while unfairly discriminating against the 86.1 percent of U.S. construction workers who choose not to join a labor union. All taxpayers should have the opportunity to compete fairly on any project funded by the federal government.”

The Government Neutrality in Contracting Act now awaits action in the Senate Committee on Homeland Security and Governmental Affairs.

AHRI Calls on EPA to Avoid "Chaos" and Modify HCFC Rule

The Air-Conditioning, Heating, and Refrigeration Institute (AHRI) today called on the Environmental Protection Agency (EPA) to modify its proposed rule governing the sale of equipment pre-charged with HCFC-based refrigerants (R-22, R-142b, and their blends).

In testimony before the EPA, AHRI Vice President of Regulatory Policy and Research Karim Amrane stated that the proposed rule "goes well beyond its original intent," which was to close a loophole on imported products containing HCFCs, to match the ban on domestic manufacturing of products that use virgin R-22 or R-142b beginning January 1, 2010.

While the proposed rule would close this loophole, it also would introduce new problems that could have a devastating effect on U.S. manufacturers. The proposed rule contains an unconventional definition for the "date of manufacture" -- one that shifts the meaning from the date the equipment leaves the factory to the date it is installed. Left unchanged, this definition would ultimately accelerate the phaseout timeline by six to 12 months because manufacturers would likely immediately stop producing condensing units charged with virgin HCFC refrigerants.

Amrane said that industry will manufacture an estimated 2 million HCFC condensing units in 2009, and if they were unable by law to be sold, stranded inventory costs could be well in excess of $500 million, "enough to bankrupt several manufacturers and suppliers," he said.

On behalf of AHRI, Amrane also forcefully objected to a provision in the proposed rule that would prevent U.S.-based manufacturers of HCFC-charged equipment from exporting it to Article 5 countries where, he said, "it is perfectly legal" to use those refrigerants. Keeping that provision intact would disadvantage and penalize U.S. manufacturers because their foreign competitors would face no such ban in those nations. The net effect, said Amrane, would be "the export of U.S. manufacturing jobs."

Finally, Amrane called on the EPA to modify the rule to exempt pre-charged appliance components, such as thermostatic expansion valves (TXVs), from the refrigerant ban. Failure to do so, he said, would prevent consumers from obtaining needed replacement parts for the installed-base of HCFC equipment.

The solution, according to Amrane, would be for the EPA to modify the rule to use a more conventional definition of the term "manufacture" to mean "when the product leaves the manufacturer's final assembly process, is packaged for shipment, and placed into initial inventory;" and to exempt products intended solely for export and pre-charged components from the rule.

BUILDER CONFIDENCE IN MULTIFAMILY MARKET SLIPS IN THIRD QUARTER

Builder confidence in the multifamily housing market sagged in the third quarter of 2008, pushing both the Multifamily Condo Market Index (MCMI) and the Multifamily Rental Market Index (MRMI) to their lowest levels since the National Association of Home Builders created the indexes in 2003.

"We have a serious supply/demand imbalance in the housing market, coupled with a weakening job market, and stringent credit market conditions, and that is negatively impacting the multifamily sector," said David Seiders, NAHB's Chief Economist.

The component of the MRMI that gauges supply was dramatically lower for both market-rate and affordable apartments, standing at 22.2 and 15.7 respectively for the third quarter. At the same time last year, the same component stood at 43.8 for market-rate and 44.3 for affordable apartments.

NAHB's Multifamily Market Indexes are derived from a quarterly survey of multifamily builders and developers in which their responses are rated on a scale of 0 to 100, with a rating of 50 generally indicating that the number of positive responses is about the same as the number of negative responses.

The MCMI, which gauges current and expected supply in the condominium market, sank into single-digits for the first time: the index value for current conditions stood at 8.1 in the third quarter, dropping more than five points from 13.5 at the same time last year. Builder confidence in the condo market over the next six months remains low as well: the index tracking this measure fell from 20.8 in the third quarter of 2007 to 9.9 in the third quarter of this year.

Apartment builders are not optimistic about the next six months either--the component tracking expectations for supply for market-rate apartments fell from 47.1 in the third quarter of last year to 19.1 in the third quarter of this year. Affordable housing developers were even more pessimistic: the component of the index tracking their expectations for supply over the next six month slipped to 20.3 in the third quarter of 2008, down from 39.1 at the same time a year ago.

According to David Seiders, even in those markets where the rental apartment demand and supply are in balance - or where demand exceeds supply-- multifamily developers have been unable to get new projects started because of the ongoing credit problems in the capital markets. Since early this year, NAHB has ratcheted down its forecast for multifamily housing starts substantially.

FDIC Bank Takeovers Hurting Home Sales, Builders Report

Home builders with outstanding construction loans are reporting that they are having to stop work on new housing developments and are losing sales as the result of failed banks and thrift institutions being taken over by the Federal Deposit Insurance Corporation (FDIC).

“Builders with outstanding loans that are placed under FDIC control are frequently unable to contact a decision maker to deal with routine but time-sensitive matters related to loan draws or extensions,” NAHB President and CEO Jerry Howard said in a Nov. 20 letter to FDIC Chairman Sheila Bair.

“Some builders have encountered what seem to be arbitrary criteria on whether or not loans receive continued funding,” Howard added. “Again, these developments are unnecessarily turning good loans into problem assets that will significantly exacerbate the losses that must be absorbed by the FDIC and the building and banking industries.”

Reports of severe financing problems stemming from FDIC bank takeovers have started proliferating among builders in Texas, a part of the country whose housing markets have been performing notably better than the national average.

One builder, for example, complained that he has been unable to receive a draw on his construction loan for more than four weeks and, as a result, has been unable to finish work on homes that have already been sold. He said that there is a possibility that the FDIC will also require another appraisal of his homes, which would cause more delays and further jeopardize the viability of his project.

In his letter, Howard praised the efforts of the FDIC to limit mortgage foreclosures, but noted that housing production loans are now experiencing the same kind of severe stress afflicting the home mortgage credit sector.

“Home builders are having extreme difficulty in obtaining credit for viable projects, and those with outstanding construction and development loans are experiencing intense pressure as the result of requirements for significant additional equity, denials on loan extensions and demands for immediate payment,” he told Bair. “In many cases, performing loans are rendered nonperforming as a result of these actions.”

Howard asked for an opportunity to meet and work with the FDIC to address “this serious and urgent issue.”

Adverse economic and credit conditions severely weaken construction

The weak economy and tight credit conditions, coupled with severe job losses and the resulting decline in state government revenues, will translate into significant weakness for the construction industry through 2010, leading the Portland Cement Association (PCA) to again adjust its cement consumption forecast.

The latest PCA forecast of cement, concrete, and construction predicts a 12.8 percent decline in cement consumption in 2008, followed by 11.9 percent and 2.1 percent declines in 2009 and 2010, respectively.

The PCA report cites the continued drop in residential starts and the erosion of the strong fundamentals supporting nonresidential construction as major factors leading to reduced cement consumption. The weak economy also has affected the public construction sector.

“Several economic factors are negatively influencing the construction industry,” Edward Sullivan, PCA chief economist said. “High energy prices, the sub-prime crisis, the melt-down of our financial markets, inflation, job losses and tight lending standards are combining to create weak economic conditions and the emergence of huge state deficits. Public construction accounts for nearly half of all the total cement consumption in the U.S., and states in poor fiscal condition will need to cut back on this spending.”

PCA expects cement consumption in residential to decline 31.7 percent in 2008 and 16.9 percent in 2009, but a rebound of the market in the second half of 2010 will lead to a 12.1 percent increase in consumption in that year. Consumption in the nonresidential sector is expected to decline 22.2 percent in 2009 and the public sector will see 6.6 percent declines in 2009 and 2010.

“The nonresidential construction market typically takes 18 months from the onset of better economic conditions to rebound,” Sullivan said. “With weak consumer spending, this sector will be especially hit hard in retail construction.”

PCA predicts a recovery to begin in 2011 with a 10.3 percent increase compared to 2010 consumption and a return to near-record consumption levels by 2013.

Construction Input Prices Fall in October

Summary

Construction input prices fell 2.8 percent in October – the largest one-month decrease since July 1986 – according to the November 18 producer price index (PPI) report by the U.S. Labor Department. Despite the dramatic decline, construction input prices remain 10 percent higher than October of last year (see graph below).

Prices for fabricated structural metal products dropped by 0.6 percent in October, but are still 15.1 percent higher than one year ago. Plumbing fixtures and fittings prices dropped slightly in October by 0.1 percent, however they are up a relatively modest 4.1 percent from October 2007. Nonferrous wire and cable prices dropped 7.7 percent – the largest monthly decline since 1949. The decrease brings the year-over-year change down 5.4 percent from October 2007. Prices for fabricated ferrous wire products increased 2 percent in October following a slight decrease in price the month prior. Still, prices are up an astonishing 30.55 percent from a year ago. Softwood lumber prices decreased 7.4 percent from September, the largest monthly decrease since November 2004, and are now down 8.8 percent from last October. In contrast, asphalt felts and coatings prices continue to increase, rising 5.7 percent from last month and up 60.2 percent from a year ago.

Crude energy prices dropped significantly, down 24.9 percent in October, with crude petroleum down 26 percent and natural gas down 29.1 percent. Gasoline prices dropped 24.9 percent on a monthly basis. Finished energy good prices fell 12.8 percent from the previous month. Overall, prices for finished goods decreased 2.8 percent, making it the third consecutive monthly decrease.

What This Means

"Even as the broader economy continues to deteriorate, and is increasingly frustrating development and construction efforts, the seeds of the next recovery are being sown," said Associated Builders and Contractors' (ABC) Chief Economist Anirban Basu. "With construction materials prices generally in retreat, developers will find it easier to make their pro formas work. However, in the near term, this may make little difference to contractors and others in the construction supply chain since the credit crunch continues with little sign of abatement," said Basu.

"Even though certain materials costs are declining, developers are finding that the revenue stream for new construction, such as new tenants, is weak," added Basu. "Therefore, revenue projections related to prospective development remain muted.

"One of the big winners in declining materials prices is the federal government," said Basu. "The next stimulus package will likely possess a significant infrastructure component, and with lower materials prices, the federal government will be able to purchase more infrastructure per dollar. This would appear to be an advantageous moment for the nation to begin to build its 21st century infrastructure, since such investment would address both short- and long-term economic considerations."

HOUSING AFFORDABILITY NATIONWIDE RISES TO HIGHEST LEVEL IN FOUR YEARS

With home prices decreasing and interest rates holding at historically low levels, the number of potential home buyers nationwide who can afford to buy new and existing homes has reached the highest level in more than four years, according to the National Association of Home Builders/Wells Fargo Housing Opportunity Index (HOI) released today.

According to the third-quarter HOI readings, 56.1 percent of all new and existing homes that were sold were affordable to families earning the national median income of $61,500, far more than the 40.4 percent of families who could afford homes at the peak of the housing boom.

"If there is a silver lining to this crisis, it would be that some housing markets have become more affordable with a larger inventory to choose from," said NAHB Chairman Sandy Dunn, a home builder from Point Pleasant, W.Va. "But this is undeniably a crisis and Congress needs to act on housing stimulus to get the market moving again."

The two most affordable major housing markets in the country during the third quarter of the year were Indianapolis, Ind., and Youngstown, Ohio, according to the HOI. In both Indianapolis and Youngstown, 91.0 percent of homes sold in the third quarter were affordable to families earning the areas' median household incomes of $65,100 and $52,000, respectively.

Also near the top of the list for affordable major metropolitan areas were Grand Rapids-Wyoming, Mich.; Warren-Troy-Farmington Hills, Mich.; and Detroit-Livonia-Dearborn, Mich., in that order.

One smaller metro market (fewer than 500,000 people) outranked all others in terms of housing affordability during the third quarter of 2008 -- Springfield, Ohio, where 92.9 percent of all homes sold in the period were affordable to families earning that area's median household income of $54,500.

New York-White Plains-Wayne, N.Y.-N.J., was the nation's least affordable major housing market for the second consecutive quarter. In the New York market, 10.6 percent of the new and existing homes sold during the third quarter were affordable to those earning the area's median family income of $63,000.

Other major metro areas at the bottom of the housing affordability chart included San Francisco-San Mateo-Redwood City, Calif.; Nassau-Suffolk, N.Y.; Los Angeles-Long Beach-Glendale, Calif.; and Miami-Miami Beach- Kendall, Fla., in that order.

Among smaller metro areas, the other markets at the bottom of the affordability chart were San Luis Obispo-Paso Robles, Calif.; Santa Cruz-Watsonville, Calif.; Napa, Calif.; and Bend, Ore., respectively.
